History & Background

In 1995 Cotton Farmers were hit with one of the worst Boll Worm attacks on their crops they had ever experienced.  As a result, there was a mass conversion to the new transgenic variety of seed produced by Delta & Pine Land in conjunction with Monsanto.  In October of 1995 Delta & Pine Land Company announced approval of a new transgenic cotton seed that would prevent against attacks of Boll Worms and Bud Worms.  Farmers flocked to this new more expensive seed in their efforts to recover from the devastating results of the 1995 Boll Worm attack.  NuCOTN® 33-B provided acceptable returns in Pounds per acre during 1996, 1997 and 1998, but 1999 saw a dramatic drop in yield.  Many farmers  had just begun to make a comeback from the devastating Boll Worm attack of 1995 only to be hit by inexplicable drops in yield of 50% and more in 1999.  Some farmers had begun planting most of their land in NuCOTN 33-B, and the drop in yield hit these farmers especially hard.  

Legal Issues Surrounding NuCOTN 33-B ®

Low yields resulted in the loss of tons of cotton lint and thus millions of dollars in revenue.  Tyner Law Firm, P.A. has been investigating this yield loss and has discovered evidence that D&PL may have rebagged old seed to make up for a shortfall of available seed in 1999.   The investigation shows that after years of declines in

 

 

acres of cotton planted in Mississippi, there was an upturn in acres planted in 1999.  Evidence shows that rather than fulfill demand with non-gene altered seed (traditional seed)  D&PL utilized old seed that was previously discarded in land fills.  The cost of the genetically modified seed is 20 to 30 times that of tradition non altered seed.  Damages suffered by farmers varies, and many lost hundreds of thousands of dollars.  The action is to recover the lost revenue that the resulted from reduced yields as a result of the distribution of  contaminated and poor quality seed.
